Australian Collection Notice

For the purposes of this Collection Notice:

“Personal Information” means personal information as defined in the Privacy Laws, namely: information or an opinion about an identified individual or an individual who is reasonably identifiable;

(a) whether the information or opinion is true or not; and;

(b) whether the information or opinion is recorded in material form or not such as that individual’s identity, social security number, driver’s license number, telephone number, credit or debit card number, address, e-mail address, account information, payroll information, financial information, employee identification number, place of birth, mother’s maiden name or employment history and includes “sensitive information” as that term is defined under the Privacy Act 1988 (Cth) such as health information, criminal history, genetic information, biometric records, racial or ethnic origin, political opinions, religious beliefs or affiliations, philosophical beliefs, membership of a political association, professional or trade association or trade union, sexual orientation or practices or other factors specific to that individual’s physical, mental, economic, financial or cultural identity.

“Privacy Laws” means the Privacy Act 1988 (Cth) and any other applicable laws, directives and regulations governing the privacy confidentiality, processing and transit of Personal Data.

“SmartCom” means SmartComms PTY Limited, A.B.N. 31 110 278 521, whose registered office is situated at Level 14, 264-278 George Street, Sydney, NSW 2000

This Collection Notice applies to the Personal Information SmartCom collects about its customer, customer’s employees and users of the Smart Communications Services, including names, usernames, phone numbers, email addresses and billing information associated with a user or customer’s account which may be processed for the purposes of providing support services and/or administrative services such as finance and billing and user account management (the “Ancillary Services”). To the extent a customer discloses Personal Information about any customer’s employees or users to SmartCom, customer must notify each of these individuals of the matters set out in this Collection Notice prior to disclosing their Personal Information to SmartCom.

SmartComms PTY Limited (SmartCom) collects Personal Information (including name, contact details, telephone number, email and customer preferences) so that SmartCom can:

  • Contact customer concerning the Services and their administration;
  • Manage the relationship with customer;
  • Provide customer with products, services and information;
  • Provide customer with support services;
  • Manage and set up accounts; and
  • Develop and improve SmartCom’s services and obtain feedback.

 

SmartCom will also use the contact information details customer (or a customer employee or user) has provided to send customer marketing information and materials related to SmartCom’s products and services, including, where customer has opted in, via email or other digital communications.

SmartCom generally collects Personal Information directly from customer, such as when customer employees or users contact and corresponds with SmartCom (e.g. over the phone, via email or in person).

If Customer employee or users do not provide the Personal Information requested, SmartCom may not be able to provide customer with products, services and assistance to the extent that they require SmartCom to collect, use or disclose Personal Information.

SmartCom may disclose Personal Information to SmartCom’s related companies, contractors providing services to SmartCom and to other third-party service providers (such as cloud hosting service providers and service providers that assist SmartCom with providing support services to customers, managing customer data (setting up accounts to access the platform) and administrative and finance related functions) SmartCom uses in conducting its business. Some of these third parties (and SmartCom’s related companies) may be located overseas; customer’s Personal Information may be disclosed to countries including UK, Ireland and the U.S.
