SMART COMMUNICATIONS FUTURE OF FINANCIAL SERVICES VIRTUAL EVENT TERMS AND CONDITIONS

Information on how you participate in the Prize Draw (as defined below) form part of these Terms and Conditions.

The promoter and organiser of this Prize Draw is SmartComms PTY Limited (ABN 110278521) whose registered office is situated at Level 14, 264-278 George Street, Sydney, NSW 2000 (“SmartCom”).

SmartCom are sponsoring the FST Future of Financial Services virtual event in in Sydney taking place on between 9am -1pm AED on 4th, 5th and 6th November 2020 (“Event”).

Eligibility: Entry to the Prize Draw is only open to Australian residents aged 18 years or over who attend the Event and who booked and attended a meeting with SmartCom during the Event. Employees, contractors and consultants (and their immediate families) of SmartCom and agencies associated with this Prize Draw are ineligible to enter.

On booking and attending a meeting with SmartCom at the Event, any eligible participant will automatically be entered into the Prize Draw to win an E-Voucher worth $200 AUD for dinner for 2 (“Prize Draw”) and is deemed acceptance of these Terms and Conditions. If you do not wish to participate in the Prize Draw, please let SmartCom know when booking the meeting at the Event. Prizes are not transferable or exchangeable

There is a limit of one (1) entry per eligible individual.

SmartCom reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who SmartCom has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Prize Draw. Errors and omissions may be accepted at SmartCom’s discretion. Failure by SmartCom to enforce any of its rights at any stage does not constitute a waiver of those rights. SmartCom ’s legal rights to recover damages or other compensation from such an offender are reserved.

If there is a dispute as to the identity of an entrant, SmartCom reserves the right, in its sole discretion, to determine the identity of the entrant.

All valid prize Draw entries will have an equal chance of winning in the Prize Draw. SmartCom ’s decision is final, and no correspondence will be entered into. The winner of the Prize Draw will be notified by SmartCom within one (1) of the Event. The winner of the Prize Draw will receive the E-Voucher via email to their nominated corporate email address within one (1) month of the Event. The E-voucher must be redeemed by the date stated on the E-voucherRedemption of the E-vouchers may be subject to other terms and conditions as stipulated by the provider. The E-Voucher is not transferable or exchangeable

If for any reason has not provided a valid corporate email address prior to taking part in the Prize Draw, then the prize will be forfeited. SmartCom will re-draw the winner by random selection.

If this Prize Draw is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of SmartCom, including but not limited to technical difficulties, unauthorised intervention or fraud, SmartCom reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Prize Draw, as appropriate.

Except for liability that cannot be excluded by law, SmartCom (including its respective officers, employees and agents) shall have no liability to any participant or any other party for any loss or damage arising from participation in the Prize Draw or from these Terms and Conditions including (but not limited to): (a) any personal injury; (b) any loss or damage; (c) any technical difficulties or equipment malfunction (whether or not under SmartCom ’s control); (d) any theft, unauthorised access or third party interference; (e) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by SmartCom); (f) any variation in prize value to that stated in these Terms and Conditions; (g) any tax liability incurred by a winner or participant; or (h) taking of the prize. In no event shall SmartCom be liable for any indirect, incidental, consequential, special, or exemplary damages or lost profits, even if advised of the possibility of such damages.

COLLECTION NOTICE: This Collection Notice applies to the Personal Information (“PI”) SmartCom collects about any individual who books a meeting with SmartCom, including names, phone numbers and email addresses. SmartCom collects PI so that SmartCom can manage the relationship and provide products, services and information. In line with the Privacy Policy, SmartCom will also use the PI for marketing information and materials related to SmartCom’s products and services, promotional, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. SmartCom generally collects PI directly (e.g. over the phone, via email or in person).

By booking a meeting with SmartCom and/or by participating in the Prize Draw, you consent to your first name, last name, company name, title and corporate email address being shared with SmartCom and its affiliates located outside of Australia (including the United Kingdom and the United States of America).  SmartCom will deal with your personal information in accordance with the privacy policy https://www.smartcommunications.com/external-privacy-policy/ (“Privacy Policy”).
