SMART COMMUNICATIONS PRIZE DRAW TERMS AND CONDITIONS

Information on how to enter and the prize draw form part of these Terms and Conditions.  Participation in the survey is deemed acceptance of these Terms and Conditions.

The promoter and organiser of this event is SmartComms PTY Limited (ABN 110278521) whose registered office is situated at Level 14, 264-278 George Street, Sydney, NSW 2000 (“SMARTCOM”)

Entry is only open to Australian residents aged 18 years or over and attended or registered for the FST Insurance event in Sydney on 5 March 2020 (“Event”).

Employees, contractors and consultants (and their immediate families) of SMARTCOM and agencies associated with this promotion are ineligible to enter.

The competition ends at 16:00 AEST on 30th April  2020 (“Promotional Period”).

The prize consists of one (1) $100 Amazon Voucher, (1) $100 E-Gift card Magazine subscription, (1) $100 E-Gift card for Netflix. Prize is not transferable or exchangeable.

To receive an automatic entry, eligible individuals must complete the survey by 16:00 AEST on 30th April 2020. There is a limit of one (1) entry per eligible individual.

SMARTCOM reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who SMARTCOM has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at SMARTCOM ’s discretion. Failure by SMARTCOM to enforce any of its rights at any stage does not constitute a waiver of those rights. SMARTCOM ’s legal rights to recover damages or other compensation from such an offender are reserved.

If there is a dispute as to the identity of an entrant, SMARTCOM reserves the right, in its sole discretion, to determine the identity of the entrant.

All valid entries will have an equal chance of winning the draw. The draw will take place at Level 14, 264-278 George Street, Sydney, NSW 2000, Australia.

The winner will be the first valid entry drawn by random selection and will receive one of three gifts via email to their nominated email address.

SMARTCOM ’s decision is final, and no correspondence will be entered into.

The winner will be notified by email within two (2) business days of the draw by SMARTCOM.

Reward vouchers must be redeemed within 60 days of being issued by SMARTCOM. Redemption of the reward voucher may be subject to other terms and conditions as stipulated by the above mentioned suppliers.

Subject to the unclaimed prize draw clause, if for any reason the winner does not confirm their email address for the prize distribution within a month of being notified by SMARTCOM, then the prize will be forfeited. SMARTCOM will re-draw the winner by random selection.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of SMARTCOM , including but not limited to technical difficulties, unauthorised intervention or fraud, SMARTCOM reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, SMARTCOM (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, SMARTCOM (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under SMARTCOM ’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by SMARTCOM) due to any reason beyond the reasonable control of SmartCom ; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.

By participating in the survey, you consent to your first name, last name and email address will be shared with SMARTCOM and its affiliates if selected as the monthly prize winner in order to generate and distribute the prize.  SMARTCOM will deal with your personal information in accordance with their privacy policy. If you do not want your information to be shared with SMARTCOM you should not enter this competition.

SMARTCOM will use and handle the personal information which it holds about its customers (“PI”) as set out in its Privacy Policy, which can be viewed at https://www.smartcommunications.com/external-privacy-policy/. In line with the Privacy Policy, SMARTCOM may use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of SMARTCOM. SMARTCOM may disclose PI to its service providers outside of Australia (for a list of the countries, see SMARTCOM ’s Privacy Policy).
